1. Subject The subject of this agreement is the non-commercial access and usage, including reproduction whole or in part, of digital spatial data through the Licensor by the Licensee for the purposes of the AR-4-Basel Project.
This agreement specifies the terms and conditions for use of the BT's geodata. By submitting this request for the data set, the Licensee agrees to comply with and be bound by the following terms and conditions of use. If you do not accept these terms and conditions, use is not authorized.
2. Research Project and License Grant In consideration for the participation of the BT serving in the role of an AR-4-Basel Project Partner, the licensor shall grant, free of charge, a non-exclusive license for non-commercial and not-for-profit use of the below listed spatial data of the Canton of Basel-Stadt solely for the activities set out in the AR-4-Basel Project.
Project Description: The AR-4-Basel project establishes a framework in which creative professionals using Augmented Reality tools can push the envelope of what has been done in Smart Cities with 3D and 2D data sets and to showcase the first generation of mobile AR services that are available to the public in Basel with smartphones and AR-compatible mobile devices (e.g., tablets) during an event on October 25, 2011
This project coordinates resources in the city of Basel, and internationally for the purpose of demonstrating how real world mobile AR experiences implemented on the basis of open city data can bring value to citizens and visitors of the city.
Expected Results: Mobile AR experiences with high accuracy and low latency.
3. Data layers and parameters Under this license, the Licensor shall provide the Licensee the following:
Tourism information data set in English, German, Spanish, French via Excel file with URL to online-xml with geolocalized information
Grouped by language according to: - news - sightseeing (monuments) - museums - events - nightlife - shopping - tours….
Perimeter is the entire City of Basel (WGS 84).
4. Terms of Use a) Other than the rights accorded under this license and only for the purpose and duration set out herein, all rights regarding access, use and reproduction shall remain with the Licensor.
b) Without limiting the generality of 4a) above, any use of the listed records, data or parts thereof, either wholly or in derived form, for other purposes than those set out in point 2 above, are prohibited under the terms of this agreement. Any other such use, access of reproduction of the data must be the subject of a new/separate agreement between the parties.
c) All graphical and electronic products that use data set out in Section 3 above must bear the following copyright notice: © 2011 Basel Tourism
d) There will be no charge for data processing and data sharing within and amongst the research project partners.
e) This agreement may be terminated by either party, on one month's notice, but shall in any case terminate no later than October 25, 2012.
5. Final Provisions a) The interpretation and enforcement of this agreement shall be governed by the federal law of Switzerland and the cantonal law of Basel-Stadt for the use of geodata and the enforcement of copyright.
b) The Licensee in this agreement shall enforce the terms and conditions thereof with regard to their employees.
c) The Licensor shall have no liability for the accuracy of the spatial data provided under this agreement and the Licensee agrees to save harmless the Licensor for any actions or responsibilities relating to the accuracy of the spatial data.
d) The Licensor and Licensee agree that any litigation with regard to this matter shall be brought to the court of ordinary jurisdiction in the Canton of Basel-Stadt.
